Comunidades Indígenas e a Necessidade de Criação de um Regime Jurídico Sui Generis

As comunidades tradicionais indígenas possuem conhecimentos sobre manejo com os recursos naturais por meio da adoção de técnicas sustentáveis, além de amplo domínio sobre as propriedades das plantas, as quais necessitam de uma regulamentação própria para que não sejam perdidas, ou roubadas, por práticas biopiratas. Neste sentido, a garantia legal precisa ser priorizada com a criação de de um regime jurídico sui generis para tratar dos anseios dessas comunidades e evitar a usurpação de seus conhecimentos para fins estritamente econômicos. Entende-se que um regíme jurídico especial para as comunidades tradicionais precisa nascer e ser debatido, negociado, dialogado entre os interessados, com base no respeito mútuo e na prática da tolerância.
