The refusal of the “naturalistic fallacy” as one of the epistemological foundations of the pure theory of law

The naturalist falsehood, as described in the works of David Hume and George Moore, occurs when the connection of a propositional copulation of the order of being, as it is and not is, to a proposition in the order of duty to be, as should and as should not be. In other words, there is a class of fact statements that is logically different from the class of value statements. In this article we analyze how the rejection of the naturalist falsehood constitutes one of the most important conceptual tools of the Kelsenian work, present from the work that inaugurates the project of the Pure Theory of Law, the work “The capital problems of the legal theory of the State” to the posthumous edition of the “General Theory Of Norms”, where Kelsen explicitly refers to the contribution of David Hume to his normativist conceptual system.
