Neoliberalism and legal education: Some reflections on education as a driving force for a democratic (re)ascension

Abstract

This essay addresses the impacts of the neoliberal world rationale on Brazilian society and democracy, as well as the role that legal education can play in both the emancipation of the individual and in curbing the authoritarian intentions that surround the Brazilian State and, consequently, working as a driving force for democratic (re)ascension. To this end, the origins, characteristics and consequences of neoliberalism are investigated, followed by a discussion about current aspects of the precariousness of legal education. In the end, it is concluded that only a critical, humanistic and plural legal education, based on the tripod of teaching, research and extension, can be widely useful for society, to the extent that in addition to contemplating the fundamental right to education and, consequently, assisting in the formation of the citizen-subject, collective and community, can also help in solving the problems arising from the failure to fulfill the promises of democracy, diagnosed so long ago by Norberto Bobbio.
