This study is related to difficulties in accessing assisted reproduction, which lead individuals to seek domestic artificial insemination as an alternative for conceiving children. The objectives of this work are: to analyze how the practice of domestic artificial insemination fits into the context of health care; and identify the main cause of lawsuits involving domestic artificial insemination. This is an exploratory research with a qualitative approach, with a study of jurisprudence of the courts of Justice of the southern and southeastern states of Brazil related to the issue. The practice of the domestic artificial insemination points to the scarcity of access to Assisted Reproduction. Dissatisfaction with the children registration in these situations often results in lawsuits. The domestic artificial insemination, by itself, evidences the lack of access to reproductive health policies, which constitutes a denial of rights for this portion of the population. In addition, due to the prevalence of female same-sex couples among domestic artificial insemination users, there are also challenges related to the registration, with adequate parental inclusion, of children born from this practice.
