Between normative status and intrinsic value: The meaning of human dignity in the foundation of human rights

Starting from the context of the second half of the 20th century, with the creation of the United Nations (UN) and the adoption of the Universal Declaration of Human Rights in 1948, this paper problematizes human dignity as the foundation of human rights. Based on the hypothetico-deductive method, it begins with the hypothesis that the term “dignity,” as used in international human rights normative texts, harkens back to the natural law conception of rights, which grants intrinsic and absolute value to human beings. In general, from Kant’s perspective, dignity is justified through a combination of natural law doctrines that advocate for the natural equality among human beings and the existence of an intrinsic moral value in humans. However, analyzing the international normative production regarding human rights reveals that the traditional conception of dignity may not meet the contemporary legal and institutional expectations outlined in international treaties. For this reason, the present investigation argues for an alternative conception of dignity, understanding it as an essentially legal concept, whereby every human being possesses a certain legal status in relation to their particular contexts of exclusion, violence, and discrimination, which legitimizes the claim for the protection of their human rights.
