LA DESOBEDIENCIA AL DERECHO Y SU POLÉMICA JUSTIFICACIÓN

O presente texto trata da desobediência civile a possível caraterização dos atos de protestos e das manifestaçõespúblicas como forma de resistência. A desobediênciacivil é apresentada como a possibilidade de se desobedecer àsleis injustas como forma pública de se questionar a continuidade da lei oudeterminada politica publica ilegítima. Questiona-se sobre a aceitação dajustificação da desobediência que se assenta em concepções morais buscandouma explicação para sua sustentação, ou seja, levantam-se dúvidas sobre se odever moral é de fato absoluto ou se suporta limitações. Em contrapartida, odever de obediência,também pressupõem uma base ética, na qual leva as pessoas a obedecerem aoordenamento. Frente à democracia, renova-se a ideia de obediência à lei,entendendo-se que há o reconhecimento de modo a legitimar determinadalegislação, fortalecendo assim a tese de que o povo está comprometido com alei. Por isso, aindatemos a obrigação moral de obedecer à lei, mas em casos especiais estaregra é contrabalançada por uma obrigação moral de desobediência.Downloads
