POLÍTICAS (SIMBÓLICAS) DE ENDURECIMENTO DO COMBATE AO CRIME, DISCURSOS PUNITIVOS MIDIÁTICOS E DIREITOS HUMANOS

As políticas criminais contemporâneas, inspiradas por discursos de índole essencialmente repressivista, podem ser consideradas enquanto políticas simbólicas de endurecimento do combate ao crime, decorrentes de uma apropriação política dos discursos midiáticos que transformam a criminalidade em uma rentável “mercadoria”. Isso pode ser considerado como um “desvio” da forma como se estruturam, no plano dos pressupostos conceituais, a política criminal e a atividade punitiva do Estado. E esse desvio representa uma séria ameaça aos Direitos Humanos, a demonstrar a premência da construção de uma política criminal consentânea com os postulados do Estado Democrático de Direito, o que perpassa pela retomada da noção de centralidade dos direitos humanos, nos moldes projetados por Robert Alexy, de forma a conter a violência estrutural e a desigualdade.Downloads
