Abstract

O trabalho objetiva analisar as condições que possibilitam o reconhecimento institucional pelo sistema de justiça brasileiro dos direitos de indivíduos formalmente iguais. Após resgatar o conceito de cidadania, busca caracterizar o capitalismo periférico vivenciado no Brasil e, por conseguinte, o lugar dos juristas no reconhecimento institucional dos (sub)cidadãos. Ao final, exemplificando com base em uma decisão judicial, pretende-se desconstruir o discurso igualitário da cidadania, indicando a perpetuação camuflada da seletividade do direito por parte dos juristas.

Graduada em Direito pela Universidade Federal de Santa Catarina (UFSC). Especialista em Direitos Humanos e Cidadania pela Universidade do Desenvolvimento do Estado de Santa Catarina (UDESC). Mestra e Doutoranda em Direito pela Universidade Federal de Santa Catarina (PPGD/UFSC). Professora da Universidade do Sul de Santa Catarina e da Escola Superior da Magistratura do Estado de Santa Catarina (ESMESC).

Helena Schiessl Cardoso, Universidade Federal de Santa Catarina

Graduada em Direito pela Universidade Federal do Paraná (UFPR). Especialista em Direito Penal e Criminologia pelo Instituto de Criminologia e Política Criminal (ICPC), em convênio com a Universidade Positivo (UP). Mestre em Direito pela Universidade Federal do Paraná (PPGD/UFPR). Doutoranda em Direito pela Universidade Federal de Santa Catarina (PPGD/UFSC). Professora de Direito Processual Penal na Universidade da Região de Joinville (Univille) e Professora licenciada da Associação Catarinense de Ensino (ACE). Advogada Criminal.
