Abstract

Este artigo tem por objetivo refletir sobre a importância e necessidade de uma proteção estatal para as pessoas LGBT, já que pertencem a uma minoria social e sexual e têm seus direitos humanos reconhecidos pela ONU, bem como a Constituição Federal prevê o princípio da igualdade no caput do artigo 5º e, ainda, dispõe que “a lei punirá qualquer discriminação atentatória dos direitos e liberdades fundamentais”, no inciso XLI, do artigo 5º. Uma das formas de garantia dessa igualdade são as políticas públicas para o combate das discriminações homofóbicas possibilitando a participação destas minorias no processo político e acesso à educação e emprego.
