The right to health in today's society is constantly challenged in terms of effectiveness. Contemporary constitutions, including Argentina and Brazil, consolidate health as a right. The challenge of these legal systems lies in achieving health. Given the context of the so-called “state crisis”, the phenomenon of judicialization of health is born. Thus, the objective of the article is to analyze the right to health in the context of the judicialization of health in Argentina and Brazil. Regarding the methodology, it is noteworthy that the article is based on the literature review of the theme. Finally, it is clear that the common ground between judicialization between the two countries is accessibility of health services and the necessary expansion of the judiciary
