UMA PERSPECTIVA NEOCONSTITUCIONAL DA REGULAÇÃO DO ESPECTRO RADIOELÉTRICO

Abstract

Este artigo tem o objetivo deslindar o conteúdojurídico do espectro radioelétrico e, a partir daí, avaliar a possibilidade,pertinência e as consequências da aplicação de uma análiseneoconstitucionalista à regulação do espectro. O estudo focará quais os efeitosda incidência dessa análise sobre três espécies de direitos fundamentais, quaissejam, direito à informação, direito à educação e a vedação ao monopólio eoligopólio dos meios de comunicação. O artigo conclui pela possibilidade e deaplicação da análise neconstitucional sobre a regulação do espectro e servecomo guia a orientar futuras instrumentalizações das garantias jurídicasreferentes aos direitos fundamentais que possam incidir sobre essa regulação.
