Constitutionalization of outsourcing of core activities in public administration and its potential impacts: An analysis from the perspective of the labor reform and ADPF 324

Outsourcing in public activities, previously focused only on "atividades-meio" (non-core activities), has been expanding to "atividades-fim" (core activities), motivated by the search for efficiency and managerial innovations. Due to the increasing use of flexible management models, it has become essential to analyze the outsourcing of core activities, its potential impacts, and its compliance with the Federal Constitution. Objective(s): To weigh the potential benefits provided by the outsourcing of core activities in public administration against the substantial challenges to its implementation. Method: Systematic bibliographic review. Development/Results: There is a lack of specific legislation regarding the object of study, which causes legal uncertainty and generates dissonance in the standardization of the understanding of Brazilian law and jurisprudence. Hence, the increase in the judicial demand to guarantee the execution or adjustments of public contracts, incurring in the increase of costs, resources, and time of implementation/execution of these, although the main justification would be speed and efficiency. Although this type of outsourcing seems more appropriate and advantageous, it proves to be incompatible with the current constitutional legal system, mitigating the rights of those most vulnerable. Admitting such constitutional incompatibility, it will be necessary to have the correct control of constitutionality and judicial intervention, as well as the delimitation of its procedural effects. A good choice of the basic justice structure would better assist in the conformation of institutions and the solidity of the transition of systems, better assisting institutions in the equitable distribution of opportunities, promoting equal access to the state structure, resources and benefits of society, and access to justice as equity.
