PACTA SUNT SERVANDA: A INFLUÊNCIA DA DECISÃO DA CORTE INTERAMERICANA DE DIREITOS HUMANOS NA JURISDIÇÃO DOMÉSTICA BRASILEIRA NO CASO DE DAMIÃO XIMENES

Analisa as consequências de ratificação de um tratado pelo Estado Brasileiro, em especial do tratado que criou a Corte Interamericana de Direitos Humanos, em face do princípio Pacta Sunt Servanda, analisando a decisão, que recebeu o nº 12.237, datado de 1º de outubro de 2004, proferida no Caso Damião Ximenes contra o Estado Brasileiro, e que determinou a sua condenação. Para tanto será adotado o método dialético e método histórico, além da análise da jurisprudência ao se analisar a doutrina existente sobre o pacto referenciado e as discussões em torno da sentença condenatória da Corte Interamericana de Direitos Humanos.
