Gender intersectionalities in the context of the feminization of migration: the (in)effectiveness of the human right to health of brazilian migrant women in Portugal under the lens of fraternal right

The theme of this research focuses on addressing Brazilian migrant women in Portugal in the context of the human right to health. The general objective is analyze the (in)effectiveness of the human right to health of Brazilian migrant women who are in Portugal from the perspective of fraternity. The specific objectives are: 1) Address the intersectional gender complexities that guide the existence of Brazilian migrant women in Portugal; 2) Analyze the (in)effectiveness of the human right to health of Brazilian migrant women in Portugal through the lens of Fraternal Law. Methodologically, the research is based on the hypothetical-deductive method, guided by a bibliographic and documentary analysis. The theoretical basis chosen to articulate the proposed analysis is the Theory of Fraternal Law, developed by the Italian jurist Eligio Resta. Given the gender intersectionalities in operation in the context of the feminization of migration, the question arises: is it possible to analyze the (in)effectiveness of the human right to health of Brazilian migrant women in Portugal through the lens of fraternal rights? It appears that as it is a common good for humanity, health needs to be accessed by everyone and structurally articulated for everyone. Thus, fraternity is a mechanism for realizing human rights, however, it needs to become a rule and transcend the theoretical plane to be incorporated into the dynamics of health policies in Portugal in favor of realizing the human right to health of Brazilian migrant women.
