Abstract

Por meio de uma perspectiva histórico-constitucional, o presente estudo aborda a problemática da efetivação dos Direitos Sociais na tentativa de resolver o seguinte problema jurídico: Qual é o papel dos Princípios da Proporcionalidade e da Proibição do Retrocesso na efetivação dos Direitos Sociais? Para tanto, identifica-se o surgimento e evolução destes direitos no mundo e no Brasil e, com propriedade, debate-se o tratamento doutrinário e jurisprudencial sobre referidos princípios enquanto mecanismos jurídicos garantidores de Direitos Sociais. Tendo em conta que tais direitos implicam custos e definições de políticas públicas de investimento pelo Estado, considera-se, ao final, que os princípios atuam como balizadores das escolhas do Executivo e Legislativo. A proporcionalidade de forma prévia, a Proibição do Retrocesso de forma posterior à implementação dos Direitos Sociais.Utilizou-se para o desenvolvimento desta pesquisa o método indutivo, operacionalizado pela técnica da pesquisa bibliográfica.

Pós-graduada em Direito Tributário pela Universidade do Vale do Itajaí - UNIVALI (2013) e em Direito Constitucional pela Universidade Anhanguera (2015). Bacharela em Direito pela Universidade do Vale do Itajaí - UNIVALI (2012). É Servidora Pública do Poder Judiciário do Estado de Santa Catarina.
