RESPONSABILIDADE E PENALIDADES APLICÁVEIS AOS PAIS PELO DESCUMPRIMENTO DOS DEVERES INTRÍNSECOS AO PODER FAMILIAR

No presente artigo analisa-se as responsabilidades dos pais quanto aos deveres intrínsecos ao poder familiar. Assim, constata-se que diante da mudança de paradigma que envolve a família, é cada vez mais frequente a ruptura das relações conjugais, originando um campo fértil para omissões e abusos quanto aos deveres parentais. Em razão disso, o Direito das Obrigações tem sido frequentemente invocado na seara do Direito de Família. Essas situações exigem cautela, pois a legislação vigente possui um vasto rol de penalidades, e a pena pecuniária em nada contribui para a aproximação entre pais e filhos. Enquanto não se tem a posição da Máxima Corte (STF) acerca do assunto surgem possíveis soluções, como o projeto de Lei nº 700/2007, do senador Marcelo Crivella, que se aprovado alterará o ECA, transformando o abandono afetivo em prática passível de punição, tanto na esfera cível quanto na penal.
