The borders of judicial interference in the arbitral proceedings

Abstract

This research aims to answer the dilemma of how arbitration and state jurisdiction are reconciled in the Brazilian context. Through a reflection on arbitration and the boundaries that surround it, it is necessary to question the limits and possibilities of judicial interference in the arbitration process. To this end, the production was structured in three topics of analysis: Judicial control over arbitral jurisdiction; Complementarity between arbitral and state jurisdictions; And, the relationship between arbitration and the judiciary. As a method of approach was applied the deductive, starting from premises considered as true to reach a logical conclusion. As method of procedure was used the monographic. It was observed as fundamental the search for the harmonic balance between the guarantee of arbitration with the due legal process. Thus, it was found that arbitration cannot be assessed by a bias of absolute independence of the judiciary, given that it is up to the state jurisdiction to provide proper support and assistance to its proceedings.
