A SITUAÇÃO DA PESSOA PORTADORA DE DEFICIÊNCIA EM RELAÇÃO À SOCIEDADE, ONTEM E HOJE

Este artigo propõe-se a analisar a situação das pessoas portadoras de deficiências em relação à sociedade como um todo, bem como verificar até que ponto essas pessoas estão, ou não, socialmente integradas e de que forma o Direito tem contribuído nesse sentido. Para isso resgata-se a trajetória histórica dos portadores de deficiência ao longo dos tempos e se verifica o tratamento dispensado a eles por parte dos mais diferentes grupos sociais. Nesse sentido pode-se afirmar que foi a partir da segunda metade do século XX que foram aprovadas normas internacionais visando tutelar os direitos dos portadores de deficiência. Embora tenham ocorrido muitas tentativas de inserção do portador de deficiência à sociedade, é preciso analisar o significado do princípio da igualdade, inserido na Constituição Federal de 1988, para entender a importância de assegurar-lhe igualdade de oportunidades, essencial para a sua integração social.
