Rio de Janeiro International Book fair and LGBTQ+ content: The limitation on visual representation of inappropriate content for children and adolescents

Abstract

This article is based on problematizing what would be the limitation for certain content to be considered inappropriate for children and adolescents, using as a main basis the case that occurred at the Rio de Janeiro Book Biennial, the Statute of Children and Adolescents and judged corresponding. The work was divided into three topics, using jurisprudential, bibliographic and legislative analysis, in addition to the deductive method. The first topic deals specifically with the arguments used in decisions related to the Biennial and whether books with a LGBTQ + theme would be considered inappropriate for children and teenagers. Then, the Statute of Children and Adolescents is analyzed, where it explains the special protection, in an attempt to understand what is considered inappropriate content, in addition to the manifestations of the Councils on the same subject. In the third topic, the STJ judges are examined in an attempt to understand the direction of this court in relation to the limitation of inappropriate content. It is concluded that the visual limitation of inappropriate content for children and adolescents is characterized by the presentation of pornographic and obscene content, which is not demonstrated in the expressions of affection of homosexual couples in the works threatened with withdrawal from circulation at the Biennial.
