Gender and alterity: A biopolytic analysis of transfeminicide in Brazil and the bet on fraternal law as counterbiopower

The theme of this research is transfeminicide from the perspective of Fraternal Law. The general objective of the investigation is to analyze the phenomenon of transfeminicide in Brazil based on the focus on Fraternal Law as a mechanism that reveals the paradoxes of biopolitics. The specific objectives are: 1) Address the murder of trans bodies based on gender in the Brazilian context and 2) Present Fraternal Rights as counter-biopower and a mechanism that produces otherness in confronting transfeminicide. The methodology chosen for the development of the research is the hypothetical-deductive approach method, guided by a bibliographic and documentary analysis. The theoretical basis is of a biopolitical nature based on the Theory of Fraternal Law, articulated by the Italian jurist Eligio Resta. Given the intersection between gender and otherness, the question arises: is a biopolitical analysis of transfeminicide in Brazil possible based on the incorporation of Fraternal Law as counter-biopower? It appears that fraternity is a biopolitical mechanism par excellence that has the potential to reveal and confront the paradoxes biopolitics embedded in the phenomenon of transfeminicide in the Brazilian context in favor of the protection and recognition of trans bodies.
