MARSÍLIO DE PADOVA: Defensor pacis

O texto busca delinear a concepção do Estado e do Direito de Marsílio de Padova, a fim de compreender conceitos teóricos que influenciaram no modo como o Estado laico e o Direito moderno foram instituídos. Marsílio escreveu Defensor pacis, uma obra que carrega o gérmen de concepções teórico-estruturais do Estado moderno, como a laicidade, a soberania popular e a legislação como fonte do Direito. Marsílio está, temporalmente, na Idade Média, mas suas concepções teóricas avançam para além do medievo, principalmente no condizente à vinculação do poder espiritual ao poder temporal e a valorização do bem comum. O método empregado foi o bibliográfico, pois a pesquisa baseou-se em análise da bibliografia e no método analítico, que ofertou o processo de observação das concepções constituintes do texto.Downloads
