DISSIMULAÇÃO DO DESESPERO: UMA REALIDADE DA REGULAÇÃO DAS RESPONSABILIDADES PARENTAIS EM PORTUGAL

Abstract

Cada vez se observam mais processos de Regulação de Responsabilidades Parentais a chegarem aos tribunais em Portugal. Esta é uma realidade que assombra não só figuras parentais e/ou tutores legais como todos os intervenientes no sistema jurídico, nomeadamente profissionais de psicologia e de direito. Mas acima de tudo assombra quem deveria ser sempre colocado numa zona de segurança, as crianças envolvidas neste tipo de processo. Em diversos momentos durante as avaliações psicológicas em em contexto forense, os sujeitos avaliados tendem a dissimular o seu comportamento. Este tipo de atitude poderá condicionar os relatórios que chegam aos/às magistrados/as. Este artigo tem como objectivo providenciar uma hipótese de reflexão sobre o tipo de atitude que os sujeitos avaliados durante a perícia psicológica poderão ter através da análise de 169 relatórios pericias realizados no Instituto Nacional de Medicina Legal e Ciências Forenses em Portugal. Os resultados alcançados apresentam que factores internos como estados depressivos e/ou paranóides poderão estar na base da possível dissimulação dos sujeitos avaliados. São ainda dadas sugestões sobre as possibilidades de avaliação que os/as profissionais de psicologia que trabalhem nesta área poderão ter durante a sua prática profissional a fim de um melhor cruzamento de informação com os/as profissionais de direito bem como com o sistema judicial onde o processo de realiza.

Author Biography

Francisco Valente Gonçalves, University of Leicester Department of Criminology

Francisco Valente Gonçalves is a Marie Curie Early Stage Researcher focused on Human Factors in Forensic Sciences, such as bias decision-making analysis. His main theme will be held in fingerprint examination and the impact of contextual information during analysis. He undertook his BSc in Psychological Sciences between Portugal (ISPA-IU) and Spain (Universitat de Valencia), having worked as an undergraduate researcher during this degree. Also took his MSc in Portugal (ISPA-IU) in Psychocriminology having worked in the National Institute of Legal Medicine and Forensic Sciences as an intern. His MSc dissertation focused on psychological assessment in forensic context. Also has completed this year a specialization in clinical intervention within the Mental Health service of Santa Maria’s Hospital in Lisboa.

Before went to Leicester he worked in risk contexts on topics as sexual abuse, addictions and personality disorders as a clinical psychologist with children, youths and adults and as a forensic psychologist in Leiria’s Prison. He’s enrolled in scientific societies (The Chartered Forensic Society, International Association for Forensic Institutes, Sociedade Portuguesa de Psiquiatria e Psicologia da Justiça) and he is also an effective member of the Portuguese Psychologist Board.
