Abstract

No plano da legislação, em especial, no campo da legislação Penal há necessidade de ser observada uma teoria da legislação que, ao final e ao cabo, possa contribuir para uma aplicação adequada do direito. A irracionalidade legal tem origem já no momento pré-legislativo, quando não levada em conta a teoria da legislação. Uma legislação elaborada sem a observância de uma teoria da legislação, fatalmente, converte-se em sinônimo de lei simbólica, pois influenciada por fins populistas e por interesses econômicos e midiáticos.

Mestra em Direitos Humanos na Universidade Regional do Noroeste do Estado do Rio Grande do Sul – UNIJUI; Pós-graduada em Direito Tributário pela UNIDERP - Universidade Anhanguera; Graduada em Direito pela Universidade Regional do Noroeste do Estado do Rio Grande do Sul – (UNIJUI).
